Does Shepard Fairey really support "fair use"? [12 Mar 2009|03:06pm]

Larkin Werner's 'Obey Steelerbaby' next to a poster by Shepard Fairey.
UPDATE: It appears that Shepard Fairey has dropped his cease-and-desist order against Cafepress and Larkin Werner's Steelerbaby store. My sources tell me it was dropped on March 10th-- days after my post about the issue.  Shepard Fairey's legal team had suggested that only he can use the word 'Obey' in a work of art. These are the same people who sent Baxter Orr a cease-and-desist letter in 2008 over the issue of "fair use". Does Shepard Fairey honestly support "fair use"? Or does he only support "fair use" when he is the one working under it? Thoughts? In his recent interview with NPR he stated that he is going against the Associated Press in order to uphold the rights of artists who work under "fair use"-- doesn't that include his work as well? After all, Obey Giant is known the world over and has been around 20 years now. In my opinion the image is open to "fair use". Thoughts?

What do you think of the AP copyright infringement allegation against Shepard Fairey? [06 Feb 2009|02:32pm]

A comparison showing Mannie Garcia’s photograph of Obama next to Shepard Fairey’s ‘Progress’ and ‘Hope’ posters. The portrait of Obama by Shepard Fairey is a stencil portrait. Fairey created a stencil over a scanned and enlarged version of the photograph that was slightly tilted according to various articles. Fairey and a gallery that represents him has stated that he did in fact use the Garcia photograph as the base image for his Obama posters according to news articles. The Assosicated Press claims to own the copyright to Garcia's photograph and  desire compensation from Shepard Fairey. Fairey's lawyer states that Fairey did nothing wrong and that is use of the image falls under fair use. Do you think his use of the image falls under fair use? Since the photograph itself is not widely known some lawyers have suggested that Fairey's use does not fall under fair use. In order for it to be fair use there must be a dialogue between the old work and the new work that is obvious to the viewer-- obvious to the majority of the public. Unfortunatey for Shepard the majority of people, including Garcia and the AP, did not make the connection between Garcia's photograph and Fairey's Obama posters. So did Fairey fail at fair use? If so, did he willfully infringe on the photograph?

I have posted several articles about Shepard Fairey and fair use that might be of interest to some of you. My thoughts, http://www.myartspace.com/blog/2009/02/art-law-professionals-weigh-in-on.html

Question and a little help needed. [12 Apr 2007|08:06am]

Hi! - I really hope this is the right place to post this, so I'm sorry if I'm terribly off topic with everything.

I just got commissioned to draw up a poster for a good friend of mine who is starting his own business. It's going to essentially be a big digital painting, something done in painter or photoshop or the like and eventually it's going to be printed up door-poster sized. So somewhere around 21x62 inches.

So I was wondering if anyone could help me work out what a good DPI/resolution it would be to work in so that I can print an image that big at decent quality? I've never printed anything bigger than a mouse-pad so I have no idea what kind of filesizes I need to create for this. So if anyone has any help here I'd REALLY appreciate it as I have a tight deadline and need to start asap.

Thanks in advance. :)

I am a graphic design professional from India and am applying for a Communications Design course in Sydney. I was wondering if someone could give me some information (specifically, I would like to know the standing the school has and the job prospects after the course) on a school called Billy Blue School of Graphic Design as I like their curriculum a lot.

Looking forward to hearing from you.
